Amid ongoing digital law reforms, govt proposes new central cybercrime forensics agency

According to a draft law seen by Dawn.com on 12/12/2024, the government has proposed the National Forensics and Cybercrime Agency (NFCA) to tackle cyber and digital crimes and investigations related to them amid ongoing efforts to change the country’s digital laws. The development comes amid ongoing efforts to reform the country’s cybercrime laws. A day earlier, newly surfaced proposed changes to the country’s cybercrime laws specified that violations could result in a seven-year prison term, with fines hiked up to Rs2 million. Last week, Dawn reported that the government was planning ‘wholesale’ changes to the Prevention of Electronic Crimes Act 2016 (Peca). These changes would see the formation of a new authority with powers to block online content and access to social media and prosecute those propagating ‘fake news’. State minister for IT and Telecom Shaza Fatima Khawaja had confirmed the plan to “address concerns regarding misinformation”, saying that the amendments were under review. Meanwhile, the draft for the NFCA Act, 2024, said it would apply to the whole country and placed the proposed agency under the interior ministry in Islamabad, adding that it could set up its offices in other places in the country. The draft explained that the NFCA comes as an upgrade to the existing National Forensic Science Authority from a project to a regular department that would act as a central coordinating agency for conventional, digital and cyber forensics across the country. It defined cybercrime as criminal activities conducted over the internet or using digital technologies that involved the use of computers, networks and electronic devices to commit offences. “Main branches include cyber fraud, hacking, cyber espionage, terrorism, online harassment and cyberbullying, cyber extortion and cyber warfare etc,” the draft said. The draft also defined deepfakes as audio, video, picture or any other form of fabricated digital media using artificial intelligence deep learning algorithms to impersonate or malign any real or imaginary person It further said that the NFCA would be the “supreme agency providing intimate conventional, digital and cyber forensics support to Islamabad Capital Territory, Azad Jammu and Kashmir and Gilgit-Baltistan as first-tier and to act as a second-tier re-examination agency for all forensics agencies/ labs in the country, including law enforcing agencies”. It would also establish a law department to “ascertain weakness in the legal system affecting conventional, digital and cyber forensics and propose amendments in laws/devise new laws”. Another main task of the agency would be to collect conventional, digital and cyber forensics material from crime scenes for examination and to provide opinions to the courts or other authorities. The draft said the agency would be headed by a director general who must be a citizen with a qualification in cyber security, artificial intelligence, information security, forensics and information technology. It outlined the proposed agency’s board of governors as the interior minister in the role of chairperson, the interior secretary as vice chairperson, the NFCA director general or director as the secretary and the other members being the chairman of the also proposed Digital Rights Protection Authority; the directors general of the National Cyber Crime & Investigation Authority (which has now been disbanded), Inter-Services Intelligence, Military Intelligence and Intelligence Bureau; the police chiefs of Islamabad, AJK and GBl; the law and justice secretary and the additional secretaries of the establishment and finance divisions. The draft said that no action taken under the proposed act would be called into question in any court and no civil or criminal proceedings would be instituted against anyone, including the government, any provincial government or any local authority, for anything done in good faith or purported to have been done under the act.

Students asked to become ‘cyber citizens’ to prevent cybercrimes

Police have called upon students to become ‘cyber citizens’ and help the cyber cell officers prevent online fraud, which has been rising. At a program organized by NTR Police at Siddhartha Mahila College on 26/11/2024, Police Commissioner S.V. Rajashekar Babu cautioned the students about cyber offenses. Students performed a cultural show alerting the public on various online frauds being reported daily. Mr. Rajashekar Babu said the NTR Commissionerate Police were taking measures to enlighten the public on the ‘1930 Call Centre’, ‘Cyber Citizens Mobile App’, ‘National Cyber Crime Reporting Portal (NCRP)’, and the Indian Cyber Crime Coordination Centre to check cybercrimes. “I request the students to be a cyber citizen. We will train the youngsters on different types of cyber offenses, how to respond immediately to online fraud, steps to prevent cybercrimes, where to complain about fraud, and other topics,” Mr. Rajashekar Babu said. Senior police officers explained to the girls about ‘honey trap’, an App’, ‘fake share marketing trade App’, ‘digital arrest’, ‘job frauds’, ‘matrimonial frauds’, ‘fake ED and CBI calls’, and other cyber offenses. “Fraudsters are resorting to frauds through various modus operandi. People should have knowledge of cyber frauds and help the police to prevent such frauds,” Mr. Rajashekar Babu said. Police are planning to create cyber citizens from different sectors. Training will be given to the cyber citizens, who will create awareness among the public on online frauds and the steps to avoid fake and spam calls, he said. The students carrying placards raised slogans against online fraud. College principal S. Kalpana, Junior College principal Dr. S. Padmaja, faculty T. Nagarani, K. Sarala, R. Madhavi and police officers participated.

Cyber criminals make fake WhatsApp accounts of Goa minister, another MLA

Several top Goa politicians including ministers were attacked by cyber fraudsters with fake WhatsApp accounts created in their names. Police complaints have been lodged at multiple police stations related to the attempt at defrauding the politicians which are under investigation at Vasco and Porvorim. Three ministers — Ravi Naik, Mauvin Godinho and Rohan Khaunte — were among the politicians targeted and all three have filed complaints. Among the MLAs Jeet Arolkar, Nilesh Cabral and Premendra Shet were targeted by the fraudsters. Some of the targeted politicians have issued public notices through social media warning their acquaintances and karyakartas about conmen seeking money through their fake WhatsApp profiles. Tourism Minister Rohan Khaunte filed a complaint at the Porvorim police station against an unknown person for impersonating him and using his name and photo on WhatsApp to send messages to people to trick them. In his complaint, Khaunte stated that on Thursday at about 2.50 pm, he was informed by his staff that an unknown person had sent him a WhatsApp text pretending to be Rohan Khaunte using his name and picture. Khaunte said he then immediately instructed his staff to check the contact number and other corresponding credentials of the said person. It was noticed that the unknown person had created a business account under his name and had used a photo which was uploaded on the website of the Goa Legislative Assembly, to make the WhatsApp contact look authentic. Khaunte then lodged a complaint against the miscreant for impersonating him and using his name and reputation to send messages to people under Section 319, 204 and 205 of the Bharatiya Nyaya Sanhita (BNS), Section 66D & 66D of IT Act, 2000 and Representation of the People Act, 1951. The minister requested the Porvorim police to register a First Information Report as the incident clearly discloses commission of a serious crime. He has also demanded an immediate investigation by police. In Vasco, a complaint was filed against an unknown person for allegedly creating a fake WhatsApp account in the name of Transport Minister Mauvin Godinho, in a fraudulent attempt to solicit money. Condemning the fraudulent activities, Godinho said, “It has come to my attention that a false message has been circulated in my name and image on WhatsApp, requesting money through an Amazon Pay e-gift card. This message is fraudulent, and I strongly condemn such malicious activities.” The minister confirmed that an official complaint has been lodged with the police, and an investigation is underway. He also appealed to the public to exercise caution when encountering suspicious requests. “I urge everyone to remain vigilant and not engage with any suspicious requests. Thank you for your cooperation and support,” Godinho added. The incident has raised concerns about online scams targeting public figures and unsuspecting individuals. Police are investigating the case.
